1. USE AND CONTENT
The user is only permitted to use this website and associated documents and files for personal information purposes. Use for any other purpose is subject to express prior permission by the media owner.
The media owner reserves the right to amend, update or delete the content and scope of this website as well as these Terms of Use without notice, or to cease to publish certain information temporarily or definitively.
Information about product properties is non-binding and is neither explicitly nor implicitly assured. All business transactions entered into with the media owner shall be done exclusively on the basis of and with reference to the applicable General Terms and Conditions of Business of the media owner in their prevailing version.
2. DISCLAIMER
The media owner shall solely assume liability for the website content which it has created and published itself. The media owner shall not provide any guarantee and/or assume any liability, be it explicit or implicit, that the services and information provided are up-to-date, accurate in terms of content, complete or of appropriate quality.
Liability for loss in connection with any use of the website is limited to intent or gross negligence on the part of the media owner. The reimbursement of lost profit, losses resulting from operational interruption as well as indirect losses of any kind shall be excluded, to the extent that this is permitted by law.
3. REFERENCES AND LINKS
This website contains links to external websites of third parties, the content of which the media owner has no influence over. Consequently, no guarantee and liability is assumed either for this third-party content. The respective host or operator of these websites is always responsible for the content of the linked websites.
The media owner hereby explicitly declares that at the time of the creation of the links, no illegal content could be identified on the linked websites. However, the media owner cannot reasonably be expected to maintain permanent control of the (future) design and content of the linked websites. Nevertheless, any such links will be removed immediately if legal infringements are discovered. Links to websites operated by third parties shall not be interpreted as a recommendation by the media owner for the services and information available there.
4. COPYRIGHT AND TRADEMARK LAW
This website as well as all content provided on this website, in particular information, data, text, images, graphics, symbols and trademarks are protected by copyright or under industrial property law and are to be used exclusively for the information of the user. The user shall undertake to refrain from any further use and from any exploitation of legally protected content of any nature, in particular duplication, storage, sale or other processing without seeking the prior explicit permission of the media owner and/or of the respective rights holder.
5. INFORMATION AND COMMENTS
Any user of this website who or which willingly makes information available to the media owner shall hereby declare that the media owner shall receive unrestricted rights in respect of this information, and that it may be used in any form. The information made available by the user shall not be subject to any duty of non-disclosure, in particular. This shall not apply to personal data, the use of which is governed by the provisions of the Austrian Data Protection Act. The data protection declaration contains further information about the careful use of personal data by the media owner.
To the extent that the user is able to leave comments on this website, prevailing laws and regulations must be complied with. The media owner shall not be held liable for unlawful content which is created by users of the website (comments). Should this give rise to legal infringements of whatever nature, the user shall undertake to hold the media owner harmless against them. If the media owner becomes aware of content which is unlawful, immoral or which is damaging to its own image (comments), it shall reserve the right to delete or block access to them. No claims may be derived against the media owner from this.
6. SEVERABILITY CLAUSE, PLACE OF JURISDICTION AND CHOICE OF LAW
Should any of the provisions of these Terms of Use become void, unlawful or impracticable, this shall not affect the validity of the other provisions. They shall be replaced by a provision which is most in keeping with the objective pursued by the media owner in the void, or unlawful or impracticable provision.
All disputes arising out of or in connection with the use of this website shall be governed exclusively by Austrian law, under exclusion of the application of the standards of the UN Convention on Contracts for the International Sale of Goods, as well as of reference standards in international private law. It is agreed that the place of jurisdiction shall be the court with material jurisdiction over the registered office of the media owner, whereby legal action may also be taken by the media owner against a website user at another court which has local and material jurisdiction over the user.
